Amazon Pushes Back against EU’s Digital Services Act, Denounces ‘VLOP’ Classification

Amazon is challenging the EU’s classification of its marketplace as a “Very Large Online Platform” (VLOP) under the Digital Services Act (DSA), arguing that the rules are too harsh and don’t fit how an online marketplace really works.

The tech giant insists its platform doesn’t pose systemic risks to users and that applying sweeping obligations designed for social media giants to an e-commerce site is arbitrary and unfair.

According to Amazon’s legal team, the DSA’s demands for tougher content oversight, risk management, and audits don’t make sense when it comes to tackling counterfeit or illegal goods sold on its platform.

In its court filings in Luxembourg, Amazon blasted the VLOP label as wildly disproportionate, insisting any problems are isolated incidents — not a platform-wide crisis. They argue that existing laws already keep things in check, and the DSA’s rules dump unnecessary burdens on marketplaces, completely ignoring how different their business is from giants like Facebook or TikTok.

Amazon isn’t the only Big Tech player drawing battle lines. Meta, TikTok, and Zalando have also pushed back against the DSA, fueling a mounting backlash against what many see as heavy-handed and ill-fitting European regulations.
