SME verification: only one administrative charge for joint application for authorisation Following the new provisions confirmed by the European Commission, we will start issuing only one administrative charge to a joint authorisation application that includes applicants with wrongly declared company sizes. This will be the case even if more than one applicant incorrectly claims to be a micro, small or medium-sized enterprise (SME). Consultations on applications for authorisation We have launched consultations on four applications for authorisation covering five uses of Chromium trioxide (EC 215-607-8, CAS 1333-82-0): hard chrome plating of moulds for the manufacture of technical rubber articles and related items for several industrial sectors;pre-treatment step (etching) in the electroplating process of plastic items for the hydro-sanitary and automotive sectors;functional chromium plating with decorative character of plastic items for the hydrosanitary and automotive sectors;long-lasting functional chrome plating on metallic substrates in demanding industrial sectors, including aeronautics, defence and transports; andfunctional chrome plating with decorative character of different metal substrates with the aim to create a long-lasting high durability surface with bright or matte look for thermo-sanitary, medical and industrial applications.Have your say using a webform until 9 October 2024. Board of Appeal
Appeal concerning a tonnage downgrade upheld In case A-001-2023, the Appellant contested a compliance check decision requesting information corresponding to the tonnage band at which it had initially registered the substance although it had updated its registration to a lower tonnage band after receiving the draft decision.
The Board of Appeal confirmed that tonnage downgrades after receipt of a draft compliance check decision must be taken into account, unless they amount to an abuse of procedure.
In the present case, in examining only the production volume in the calendar year preceding the tonnage downgrade, the Agency did not perform the necessary individual assessment of whether there had been such an abuse.
The Agency therefore breached the Appellant’s right to good administration.
The contested decision was annulled insofar as it requested the Appellant to provide information required from registrants at the higher tonnage band.
