Could law on environmental destruction help fix the ICC’s Western bias? While there is currently no international criminal law explicitly imposing penalties on environmental harm, the “Stop ecocide” movement, which is supported by Greta Thunberg and several world leaders, is pushing to change this. A law on ecocide would be unique in the ICC’s history in terms of what it would protect, but it would also mean that heads of countries and companies that are big polluters would likely face charges. A new international ecocide law could therefore have implications for the ICC’s legitimacy too, which has been criticized for its Western bias and for targeting only African dictators. If environmental destruction was to be criminalized in international law, Western leaders could increasingly be facing charges before the ICC. Larissa Lee |
