Juni 2018 das neue Verjährungs-recht. Die Referendumsfrist läuft noch bis am 4. Oktober 2018. Anlass zur Revision gab unter anderem das Schicksal von Asbestgeschädigten, deren Forderungen nach bisherigem Recht bereits verjährt waren, lange bevor ihre asbestbedingte Krankheit in Erscheinung trat. Wann das neue Verjährungsrecht in Kraft treten wird, steht noch nicht fest. Dies dürfte aber nicht vor dem 1. Januar 2020 sein. | | | | Legal News August 2018 - English | | | | Dear Clients and Business Partners Following a lengthy reconciliation process between the National Council and the Council of States, on 15 June 2018 the Parliament adopted the new law on the statute of limitation. The referendum period continues to run until 4 October 2018. The law was revised, amongst other reasons, due to the fate of persons exposed to asbestos, whose claims had already become time-barred under existing law, long before symptoms of their asbestos-related illness became apparent. It is not yet clear when the new law on the statute of limitation will come into force. However, it is not expected to occur before 1 January 2020. In the following, the most important changes to the law on the statute of limitation are briefly presented and explained. Le délai référendaire court encore jusqu’au 4 octobre 2018. Parmi les éléments qui ont conduit à la révision se posait notamment la question du sort des personnes affectées par l’amiante, dont les prétentions, en vertu de l’ancien droit, se trouvaient prescrites bien avant que n’apparaissent les premiers signes de maladie due à l’amiante. La date de l’entrée en vigueur du nouveau droit de la prescription n’a pas encore été fixée. Celle-ci ne devrait toutefois pas survenir avant le 1er janvier 2020.
