PROMOTION PERIOD: The Machinery Pete Fan Package (“Giveaway”) begins at or about 4:00pm Central Time on December 5 and ends at 11:59pm Central Time on December 12 (“Promotion Period”).
HOW TO ENTER: Any Entrant creating a Machinery Pete MarketPlace Listing ($50/month) between promotion period is automatically entered for the giveaway. To enter online, please send email to: customersupport@machinerypete.com with the subject line: “Sweepstakes Entry”. The person sending the email will be deemed the “Entrant”. By entering, Entrant certifies that he/she is no less than the age of 18 (eighteen)
RULES, ENTRY GUIDELINES, CONDITIONS & REQUIREMENTS: Each entrant can be entered into the sweepsakes one time. Administrator has the sole discretion to determine whether an entry meets the criteria set forth in these Terms and Conditions. Entries deemed to have met such criteria will be considered “Eligible Entries.”
WINNER SELECTION: Administrator will select one (1) winner from among all Eligible Entries. The winner will be selected by 5:00 PM CT on December 13 by random drawing and immediately notified of the prize by Sponsor (defined below) via email. In the event the winner doesn’t respond within 48 hours, administrator will award the applicable prize to an alternate winner from among all remaining Eligible Entries. The prize will be fulfilled no later than 3 weeks after the conclusion of the drawing, although no specific time frame for fulfillment is guaranteed by Administrator.
PRIZE: One (1) prize will be awarded during the Promotion Period. The prizes are not transferable and cannot be assigned, substituted or redeemed for cash. Administrator reserves the right to substitute a prize of equal or greater value in the event that a stated prize cannot be awarded for any reason. Any federal, state and local taxes are the sole responsibility of the winners. Neither the Administrator, Sponsor nor their affiliates or subsidiaries will be responsible for any loss, liability or damage arising out of the winner’s acceptance or use of the prize. Winners acknowledge that neither Administrator nor Sponsor has made nor is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition, or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize (if any) are subject to the respective manufacturers’ terms therefor, and winners agree to look solely to such manufacturers for any such warranty or guarantee. Odds of winning depend on the number of Eligible Entries received.

PUBLICITY: Except where prohibited, participation in the Giveaway constitutes Entrant’s consent to Administrator, Sponsor and their agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

GENERAL CONDITIONS: Administrator reserves the right to cancel, suspend and/or modify the Giveaway, or any part of it, if any fraud, technical failures or any other factor beyond Administrator’s reasonable control impairs the integrity or proper functioning of the Giveaway, as determined by Administrator in its sole discretion. Administrator reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, Administrator reserves the right to seek damages from any such person to the fullest extent permitted by law. Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Giveaway; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Giveaway; (4) technical or human error which may occur in the administration of the Giveaway or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Giveaway or receipt or use or misuse of any prize. If for any reason an Entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Entrant’s sole remedy is another entry in the Giveaway, provided that, if it is not possible to award another entry due to discontinuance of the Giveaway, or any part of it, for any reason, Administrator, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Administrator reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims

RELEASE: By participating in the Giveaway or receiving any prize, Entrant agrees to and does hereby indemnify, release and hold harmless, Administrator, Sponsor, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Giveaway or receipt or use or misuse of any prize.
