So who's licensing all of this, and how? It may sound easy—artists in their living rooms or basements, playing live because there's nothing else to do on a Saturday night these days, and people need entertainment and, most important, people need help. So just hit the play button on the iPhone and go. But here's what else you or your support team has to do. The complexity of the music rights universe isn't exactly breaking news, but one suspects there are a lot of managers, agents and lawyers getting a crash course in the peculiarities of the livestreaming piece of that universe right now. CHERIE HU does her best to untangle the crossing wires of master, mechanical, performance and sync licenses in play here in various combinations, depending on whether you're spinning records or playing live, whether you're archiving the performance, and any number of other factors. Worth knowing: Major sites like FACEBOOK and YOUTUBE have blanket deals for on-demand content but not generally for livestreams. TWITCH doesn't have deals with all the PROs, Hu reports, but does have "flat-fee agreements... to avoid litigation for 12 to 18 months as its business matures." Some bizzers consider livestream-only performances to be "ephemeral" uses that don’t require sync licenses. Several publishing companies disagree. Etc.
