Explainer: Kentucky puts anti-abortion measure on 2022 ballot

On Tuesday, the Kentucky state legislature passed House Bill 91, a measure that will allow voters to decide the No Right to Abortion in Constitution Amendment in November 2022. Kentucky’s Democratic governor, Andy Beshear, has vetoed anti-abortion legislation in the past, but he does not have the authority to veto proposed constitutional amendments.

The ERLC recently joined 12 other organizations in an amicus brief asking the U.S. Supreme Court to review an opinion by the First Circuit Court of Appeals in the case Carson v. Makin on religious discrimination in a Maine tuition-assistance program. The brief was filed in mid-March, led by the Christian Legal Society (CLS), and argued that the lower-court ruling not only violated the Constitution, but also the justices’ previous decisions regarding the use of funds to provide religious instruction and the families that choose faith-based schools.

In comments about the case to Baptist Press, Travis Wussow, ERLC's vice president of public policy and general counsel said:

“We joined with a broad coalition of religious institutions and denominations in submitting this brief to the Supreme Court because families should not be discriminated against by the state simply because they educate their children in religious schools. As the justices rightly decided in Espinoza, and in Trinity Lutheran before it, excluding people based on religion from generally available public benefits runs afoul the First Amendment. Just as the government must not establish religion, in this brief we encouraged the Court to further ensure governments do not treat religious Americans worse than their non-religious neighbors.”
