#1 Boy Scouts of America Sex Abuse Settlement – For and AgainstLos Angeles, CA Voting a settlement of almost $1.9 billion to compensate over 82,000 Boy Scouts of America sexual abuse victims has begun with a December 14, 2021 deadline to vote for the Plan. But many survivors and their attorneys oppose the current proposal.
#2 USB Checking Accountholders to get their Day in CourtSan Diego, CA On August 10, the Southern District of California agreed to reconsider its own ruling in an overdraft fees lawsuit that forced the dispute into arbitration. On reconsideration, it reversed itself. This breathes new life into Reyna McGovern’s contention that U.S. Bank charged bank overdraft fees that were not permitted under the terms of the account agreement that she and many other customers signed. Now they get a chance to have their claims heard in court. The Order Granting the Motion for Reconsideration may have implications for other Californians who, perhaps unwittingly, signed arbitration agreements when they opened a checking account.
#3 Boy Scouts Sexual Abuse AgreementIrving, TX A tentative agreement has been reached with the Boy Scouts of America and some 70,000 sexual abuse victims, but there is opposition to the $850 million settlement, including sponsoring churches and insurance companies.
#4 Like Death and Taxes, There Is No Escape from a Xarelto BleedoutNew York, NY And so it begins, the parade of Xarelto death lawsuits that allege a new-age blood thinner that was supposed to be way better than old, reliable but temperamental warfarin (brand name Coumadin) isn’t all it’s cracked up to be.
#5 Supreme Court Hands DoorDash Driver a Win in PAGA CaseWashington, DC On October 12, the U.S. Supreme Court denied DoorDash Inc’s petition for certiorari, thus declining to review the decision of the California Court of Appeals in Brandon Campbell v. DoorDash, Inc. The Court of Appeals’s decision permitted Campbell, a DoorDash driver, to proceed with his Private Attorneys General (PAGA) claim, without first submitting it to arbitration. Campbell’s PAGA claim was based on his allegation that DoorDash’s payment scheme violated the minimum wage requirements of the California Labor Code.
#6 Employee Stock Ownership Lawsuit Unmasks Brazen Corporate FraudRiverside, CA The allegations made in Gamino v. KPC Healthcare are pretty lurid, especially as ERISA lawsuits go. Even apart from the loaded handgun and the slashed tires, the Complaint tells a tale of shocking financial malfeasance.
#7 Lisinopril—Hidden DangersLas Vegas, NV Many prescription drugs are as common as aspirin; it's no wonder that many consumers don't read warning labels or consider that a medication could be associated with side effects. Take Lisinopril, for instance. It is one of the most widely prescribed drugs in the US, and it also has the potential to harm a lot of people.
#8 Maker Of “Neuro” Drinks Agrees To Pay $500,000 In Fines and Restitution Neurobrands LLC, the Santa Monica-based maker of the “Neuro” line of drinks, has agreed to a permanent court injunction that requires it to change its marketing practices. The company will also pay $500,000 in penalties and restitution as part of a settlement with local prosecutors.
#9 Lisinopril Associated with Many Serious Side Effects, Including Angioedema and Liver DamageHouston, TXLisinopril, used to treat hypertension, congestive heart failure and heart attack, is associated with many side effects including liver damage. Beverly was diagnosed with angioedema (which can be life-threatening) as a direct result of Lisinopril, according to her hospital doctors.
#10 The Prilosec Lawsuit and the Negligence of Drug ManufacturersThe development of modern medicinal drugs is one of the most important breakthroughs in science. Today, we heavily rely on modern medication to treat diseases and alleviate the symptoms brought about by these diseases. Most of the illnesses that people experience can now be easily cured with a prescription drug that anyone can purchase at a pharmacy or a drug store.
