#1 $90 Million Missing -- “Embezzlement and fraud,” cry AME Pastors in Pension LawsuitMemphis, TN Count IX of this class-action ERISA lawsuit, alleges the “Tort of Outrage.” That, if nothing else, captures the flavor of the case.
#2 Maker Of “Neuro” Drinks Agrees To Pay $500,000 In Fines and Restitution Neurobrands LLC, the Santa Monica-based maker of the “Neuro” line of drinks, has agreed to a permanent court injunction that requires it to change its marketing practices. The company will also pay $500,000 in penalties and restitution as part of a settlement with local prosecutors.
#3 IBM to Settle Sales Reps Claims for $4.75MSanta Clara, CA IBM will pay $4.75 million to settle claims that it shortchanged about 1,500 sales representatives out of their rightful commissions, and that Big Blue had violated California Labor Code, according to a preliminary approval motion filed August 23rd in federal court.
#4 Class Action Toxic Tort Lawsuit Filed in Camp LeJeune Water Contamination CaseWilmington, NC On August 14, Donald Stringfellow filed a class action toxic tort lawsuit in the Eastern District of North Carolina, alleging that he and others stationed at Marine Corps Base Camp Lejeune suffered injuries because of their exposure to contaminated water. The lawsuit may ultimately include thousands of Marines and civilians who lived on base between 1953 and 1987 and were exposed to water containing cancer-causing chemicals like benzine, vinyl chloride, trichlorethylene (TCE) and perchloroethylene (PCE).
#5 Zetia and/or Statins: The Good, the Bad and the UglyHalle-Wittenberg, Germany Can a drug designed to curb heart attacks also cause heart attacks in some people? Apparently, it's possible with statins or medication like Zetia when used in combination with a statin. Statins are designed to lower the "bad" cholesterol thought to be a contributing factor for heart attack and stroke, while leaving the so-called "good" cholesterol to do the good work that good cholesterol, ultimately, does.

#7 Seroquel Side Effects for the ElderlyPearblossom, CA Seroquel is a neuroleptic indicated for the treatment of bipolar disorder—and like most drugs carries a host of Seroquel side effects, including diabetes, tardive dyskinesia and even birth defects. However, there is a little-known use for Seroquel off-label that concerned the daughter of one Alzheimer's patient for whom she was caring.
#8 Costco Settles Excessive Fee ERISA Lawsuit for $5.1 MillionGreen Bay, WI The Eastern District of Wisconsin has approved a $5.1 million settlement in Soulek v. Costco Wholesale Corporation. The settlement brings to an end another ERISA lawsuit, which alleged that plan fiduciaries failed to manage employee retirement funds prudently, as required by ERISA.
#9 Working from Home Expenses Covered—or not-- in CaliforniaSanta Clara, CA A number of California employers are facing class actions or actions under the Private Attorneys General Act filed by employees seeking reimbursement for expenses incurred while working from home during the pandemic. Even though the California Labor Code states what can and cannot be claimed, it has been written in a way that leaves room for interpretation by the courts.
