#1 Medical Malpractice Lawsuit Accuses Surgeon of Leaving Procedure EarlyFresno, CA The allegations of medical malpractice surrounding the fate of a California man and an operation gone horribly wrong are compelling. The claim is that a noted Fresno cardiologist was responsible for leaving an open heart surgery patient in a vegetative state after the surgeon left the operating theatre before the procedure was complete.
#2 Instacart Settles California Misclassification LawsuitSan Francisco, CA Instacart is settling a misclassification complaint claiming that the gig company violated the California labor code by misclassifying its workers, known as “shoppers” as independent contractors instead of employees. (Shoppers gather groceries in stores for customers and sometimes deliver them.) The city of San Diego claimed Instacart misclassified its shoppers as independent contractors in order to avoid paying them benefits.
#3 Zetia and/or Statins: The Good, the Bad and the UglyHalle-Wittenberg, Germany Can a drug designed to curb heart attacks also cause heart attacks in some people? Apparently, it's possible with statins or medication like Zetia when used in combination with a statin. Statins are designed to lower the "bad" cholesterol thought to be a contributing factor for heart attack and stroke, while leaving the so-called "good" cholesterol to do the good work that good cholesterol, ultimately, does.
#4 Maker Of “Neuro” Drinks Agrees To Pay $500,000 In Fines and Restitution Neurobrands LLC, the Santa Monica-based maker of the “Neuro” line of drinks, has agreed to a permanent court injunction that requires it to change its marketing practices. The company will also pay $500,000 in penalties and restitution as part of a settlement with local prosecutors.

Kaitlyn Lasitter survived, and doctors were able to re-attach her right foot. But they could not save her left, and Kaitlyn now walks with a prosthesis.
#6 Equinox Employees Go Ahead with Three Class ActionsLos Angeles, CA Over 9,000 Equinox employees, including personal trainers and group fitness instructors, have been given the green light by a California federal judge to have their wage claims and other California labor laws resolved by three class actions rather than individually.
#7 Seroquel Side Effects for the ElderlyPearblossom, CA Seroquel is a neuroleptic indicated for the treatment of bipolar disorder—and like most drugs carries a host of Seroquel side effects, including diabetes, tardive dyskinesia and even birth defects. However, there is a little-known use for Seroquel off-label that concerned the daughter of one Alzheimer's patient for whom she was caring.
#8 Texas Employment Law: Don't Wait to Take Your PTOHouston, TX Pete did his company a service by not taking Paid Time Off (PTO) in over four years of employment. Yesterday was his last day of work. He has accrued 150 hours of PTO, but Texas Employment law does not require that employers pay workers for earned but unused vacation upon termination, unless the employer has a written policy or past practice of doing so.
#9 Matco Tools Settles California Misclassification Lawsuit for $15.8 MillionSan Francisco, CA On April 29, the Northern District of California granted final approval to a $15.8 million settlement in a class action California labor lawsuit brought by 273 franchisees who claimed that Matco Tools classified them as independent contractors to avoid paying overtime, reimbursing expenses and providing accurate wage statements. The deal includes a $13.5 million cash payment. Distributors who terminated their distributorships on or before September 8, 2021, may also share in a fund that provides $2.3 million in debt relief.
