On November 4, the Occupational Safety & Health Administration (OSHA) released its “emergency” vaccine mandate, putting businesses with 100 or more employees in between those employees and their doctors. The rule would have forced hardworking Americans to choose between getting the vaccine, weekly testing and masking, or losing their jobs. A single willful violation of the rule could have resulted in a devastating fine of up to $136,000! Despite multiple courts temporarily halting enforcement of various federal vaccine mandates, the federal government continued to pursue implementation of the mandate. The fight is not over yet Although we rejoice at the Court’s decision, and continue to pray for a more permanent ruling, we know the battle is not over. The current administration, again through OSHA, is currently pursuing a permanent vaccine mandate on all businesses and organizations. Alliance Defending Freedom attorneys will continue to monitor the situation and work with our clients to help ensure their rights, and those of their employees, are protected from government intrusion and overreach. Regardless of our own opinions on vaccines, we should all agree that personal medical choices are just that—personal. Americans have different opinions about the COVID-19 vaccine and should be free to direct their own medical decisions, especially when they raise important religious issues. If a permanent rule were to go into effect, not only would companies (likely all businesses, not just those with 100 or more employees) be forced to insert themselves into the personal medical decisions of their employees, but they would also be required to essentially discriminate against their own employees for health decisions or disability status. No business should be required, under threat of government punishment, to demand that their employees undergo medical procedures. Your medical decisions are yours alone, and the government must respect your God-given and constitutionally-protected rights and freedoms.

In addition to the problems with the COVID-19 vaccine mandate we’ve mentioned so far, one crucial detail is that the mandate, as proposed, would place a particular burden on religious organizations, like The Southern Baptist Theological Seminary (SBTS). As with many faith-based ministries and organizations, SBTS has members and employees who have received a COVID-19 vaccination, and those who have not. The OSHA mandate would require these organizations, including religious schools and seminaries with over 100 employees, to single out employees, based on their own personal medical choices. That mandate may conflict with both the religious organizations and their employees’ religious beliefs. Religious ministries and organizations are best positioned to implement their religious beliefs, and they shouldn’t have to answer for those beliefs to an impersonal, and largely unaccountable, federal agency like OSHA. The threat to religious freedom is clear, and we rely on the support of people like you, to provide our clients, including The Southern Baptist Theological Seminary, with the defense they need, even if it means taking their cases all the way to the U.S. Supreme Court (again).
